Samsung Apple Patent War

Samsung Apple Patent War

On Tuesday, Samsung reimbursed Apple for a $1 billion infringement case.

Samsung appealed that the judge responsible for the case stated that the jury had made mistakes in calculating Apple’s losses, and the specific amount of compensation must be decided after the case was reviewed.

Samsung hopes that Apple can provide a clearer list of losses and can specify how much each type of product is lost for each specific product. Samsung said the form of the jury is too complex and is a 20-page maze of law and mathematics.

The third trial is expected to begin in March 2014. If Apple can win the retrial, it will be the second largest patent infringement case in history.

Review of the case:

On April 15, 2011, Apple sued Samsung in the United States and claimed that Samsung infringed Apple’s patent rights. Apple accused Samsung of stealing some iPad and iPad2 designs, claiming $2.5 billion from Samsung and demanding that it stop selling its tablet products.

On April 21, 2011, Samsung sued Apple in South Korea, Japan, and Germany, claiming that Apple infringed Samsung’s patent rights.

On June 28, 2011, Samsung sued Apple to the US International Trade Commission (ITC).

On August 9, 2011, the District Court of Düsseldorf issued a preliminary ban that prohibits Samsung from selling certain types of Galaxy Tab tablet computers. The preliminary ban stated that Samsung’s products allegedly infringed one of Apple’s design patents.

On September 8, 2011, Apple filed a lawsuit with the Tokyo District Court of Japan, accusing Samsung of infringing two patents related to the iPhone and iPad and claiming 100 million yen. And asked the court to issue an injunction to prohibit Samsung from selling infringing products in Japan.

On July 31, 2012 and July 31, 2012, the California State Court held a hearing to hear Apple and Samsung Electronics’ patent litigation. Apple described Samsung as an “esthetic thief” in the opening statement, accusing Samsung of stealing its inspiration rather than innovating. In August 2012, the California District Court of the United States issued a verdict that Samsung Electronics infringed several Apple patents and must compensate the other party. 10.5 billion U.S. dollars. Samsung disagreed with this and appealed.

On December 7, 2012, Apple and Samsung Electronics will re-open a hearing in the San Jose Federal Court to review the high-risk lawsuits of both parties.

On December 19, 2012, Samsung will withdraw its patent infringement lawsuit against Apple in Europe.
